Wawa Class Action Lawsuit Filed Over Data Breach

Wawa, a chain of convenience stores and gas stations, has been sued over its recent data breach. Plaintiff Tabitha Hans-Arroyo filed a lawsuit against Wawa in the United States District Court Eastern District of Pennsylvania on Thursday. The Wawa class action lawsuit comes a little more than a week after the gas and convenience store franchise announced a massive data breach on December 19th, 2019.

Customer’s credit and debit card numbers, expiration dates, and cardholder names were exposed. A malware in point-of-sale terminals in stores caused it. The company said the malware had been potentially running in all of their stores at different periods since March 4. The company discovered the malware Dec. 10, and had blocked and contained it by Dec. 12. Wawa is offering free identity protection and credit monitoring services to customers. However these are services that many people already have due to multiple data breaches of big companies in recent years.

Hans-Arroyo alleges she received an email on Christmas Eve from Capital One. It stated that a $2,535.15 Walmart.com purchase was declined because of a lack of available credit. She called Capital One to let them know that she had not authorized the purchases. During the call they told her that her card was compromised as a result of the data breach.

The lawsuit also alleges Wawa disregarded industry standards for customer data security, negligence and a breach of implied contracts. The suit also alleges the breach violated the New Jersey Consumer Fraud Act. Hans-Arroyo is seeking a jury trial and damages, among of which included actual and punitive. A specific amount was not requested. But, Wawa class action lawsuit pointed to the Class Action Fairness Act of 2005, seeking more than $5 million as a result of damages.
