What’s The Burger King Settlement About

This lawsuit alleges that certain Burger King restaurants charged a higher price for two modified CROISSAN’WICH breakfast sandwiches (each a “Croissan’wich”) when consumers redeemed a buy-one-get-one-free (“BOGO”) coupon than they would have if the consumer had purchased a single unmodified Croissan’wich® without a BOGO coupon.

The plaintiff noticed the problem when she used a BOGO coupon and was charged $3.19 pre-tax for a sausage, egg and cheese Croissan’wich (and was given another sandwich “free” as part of the deal). But when she went back to buy a single Croissan’wich without a coupon, she was charged just $2.16 before tax.

Who’s Eligible?

You may be included in the settlement if, during October 1, 2015 and May 19, 2017 (the “Class Period”), you purchased two or more modified CROISSAN’WICH® breakfast sandwiches (without egg, cheese and/or a meat) from a BKC restaurant, redeemed a BOGO coupon in connection with the purchase, and paid more than the amount that restaurant was charging at the time for a single, unmodified, higher-priced Croissan’wich® you ordered.

What Products Are Included?

CROISSAN’WICH® breakfast sandwiches (without egg, cheese and/or a meat) from a BKC restaurant, purchased with a BOGO coupon.

How Much Do I Get?

BKC will make $5 payments or provide $2 gift cards to those who submit a valid Claim Form. In addition, BKC and its employees have implemented corrective changes at the point of sale.

If you have proof of purchase you can choose either option. If you don’t then you will automatically get a $2 gift card.

Do Not Submit False Claims

Please do not submit fraudulent claims for these settlement rebates. It takes money away from those who deserve a reimbursement, and furthermore it is illegal. You’re usually required to acknowledge something along these lines:
